UK Visas and Immigration has published version 20.0 of the guidance, shown as updated on 3 August 2026. It tells caseworkers how to consider applications to enter, remain or settle in the UK under the Skilled Worker route. It is designed to be used alongside Appendix Skilled Worker of the Immigration Rules.

The section "Changes from last version of this guidance" names one item: a suitability update to immigration bail (Part Suitability). The source text does not describe what was altered from the previous version.

Section 4.2 sets out the position on immigration bail. An applicant who is in the UK on immigration bail does not hold permission to be in the UK. Such an applicant is not suitable for the Skilled Worker route, except where the Immigration Rules permit it in respect of periods of overstaying.

Section 4 explains how suitability is assessed. Caseworkers must check the application against the suitability requirements for Skilled Worker, linked out in paragraphs SW 2.1 to SW 2.2, and against the grounds for refusal in Part Suitability. Applications that do not meet the suitability requirements must be refused.

Section 4.1 covers overstaying. Caseworkers must check that the applicant is not in breach of immigration laws, except where the Immigration Rules permit periods of overstaying.

The guidance divides the requirements into three groups. Validity requirements decide whether an application can be considered in full, and applications that do not meet them may be rejected. Suitability requirements check whether the applicant can be granted any form of permission. Eligibility requirements are the criteria specific to the Skilled Worker route.

What this means for applicants

An applicant who is on immigration bail when applying for Skilled Worker entry clearance or permission to stay is treated as not suitable for the route, unless the Immigration Rules permit it in respect of periods of overstaying. If the suitability requirements are not met, the application must be refused.
