UK Visas and Immigration (UKVI) has published version 15.0 of the Global Business Mobility routes caseworker guidance. Caseworkers use it when they consider applications to enter or remain in the UK on these routes. Under "Changes from last version of this guidance", the only entry is "Part Suitability update to immigration bail".
Section 4.2 of the guidance, "Immigration bail", covers the point. It says that any applicant who is in the UK on immigration bail does not hold permission to be in the UK. Such an applicant is not suitable for the Global Business Mobility routes, except where the Immigration Rules permit in respect of periods of overstaying.
Section 4 tells caseworkers to check the suitability requirements for the relevant route. The paragraphs are:
- SNR 2.1 and SNR 2.2 for Senior or Specialist Worker
- GTR 2.1 to GTR 2.2 for Graduate Trainee
- UKX 2.1 and UKX 2.2 for UK Expansion Worker
- SSU 2.1 to SSU 2.2 for Service Supplier
- SEC 2.1 to SEC 2.2 for Secondment Worker
Caseworkers must be satisfied that the requirements in Part Suitability apply to the application.
Section 2.2 says applicants who do not meet the suitability requirements must be refused. Section 4.1 separately tells caseworkers to check that an applicant is not in breach of immigration laws, except where the Immigration Rules permit in respect of periods of overstaying.
The guidance is designed to be used alongside the Global Business Mobility appendices to the Immigration Rules. The Rules set out the requirements, and the guidance gives caseworkers additional information on how to consider an application.
What this means for applicants
An applicant who is in the UK on immigration bail does not hold permission to be in the UK. Under section 4.2, they are not suitable for any of the five Global Business Mobility routes, unless the Immigration Rules permit it in respect of periods of overstaying. Under section 2.2, an application that does not meet the suitability requirements must be refused.
