Version 18.0 of the UK Visas and Immigration caseworker guidance on administrative review records one change from the previous version: "Appendix ECAA Settlement: ECAA nationals and settlement has been inserted into the list of eligible routes."
Section 2 of the guidance, on decisions to refuse permission to enter or stay, lists the decisions that are eligible for administrative review. Appendix ECAA Settlement: ECAA nationals and settlement now appears there, directly after Appendix ECAA: Extension of Stay. As with every route on the list, the right applies where the outcome of the application is a refusal.
The guidance relates to Appendix Administrative Review to the Immigration Rules. Administrative review considers whether an eligible decision is wrong because of a caseworking error and, if it is, corrects that error. A different person, on an independent team, carries out the review.
The new entry appears only in the list in section 2. The separate list of routes for overseas administrative review of entry clearance refusals, in section 4, does not include Appendix ECAA Settlement: ECAA nationals and settlement.
The guidance gives these general terms for in-country reviews:
- The application is made online using the form at Ask for a visa administrative review.
- The fee is £80. It is refunded only if the application is rejected as invalid or the review decision is to grant leave.
- The time limit is 14 calendar days from the date the applicant receives the refusal notice, or seven calendar days if they are detained.
- Only one application per decision is permitted, unless the decision is upheld for different or additional reasons.
- An applicant cannot apply for administrative review and make a new application for entry clearance, permission to enter or permission to stay at the same time. If they make the new application after the administrative review application, the review is treated as withdrawn. If they make it first, the review application is rejected.
What this means for applicants
Someone refused under Appendix ECAA Settlement: ECAA nationals and settlement can apply for administrative review of the refusal. The refusal notice will say whether the right applies. The application must be made online, with the £80 fee, within 14 calendar days of receiving the notice (seven if detained). An application made after the deadline must normally be rejected.
Separately, the guidance exempts some applicants from the fee, for example where the original application was made without a fee, and allows a fee waiver in exceptional circumstances.
If the person makes a new application for entry clearance, permission to enter or permission to stay, any administrative review application is withdrawn or rejected. If the review is unsuccessful and the person has no immigration permission, they must leave the UK after receiving the review decision.
